Terms of Service

1. Acceptance of Terms

By accessing or using the SwitchEV platform at switchev.co (the "Service"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

2. Description of Service

SwitchEV is an online marketplace that connects vehicle owners seeking electric vehicle conversions ("Clients") with verified EV conversion shops ("Vendors"). SwitchEV facilitates introductions and communications but does not perform conversion work, provide warranties on conversions, or act as a party to agreements between Clients and Vendors.

3. Eligibility

You must be at least 18 years old and capable of forming a binding legal agreement to use the Service. By using SwitchEV, you represent and warrant that you meet these requirements.

4. User Accounts

Some features require account creation. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You agree to notify us immediately of any unauthorized use of your account.

5. Project Submissions

Clients may submit EV conversion project details including vehicle information, photos, contact information, and conversion preferences. By submitting a project, you consent to sharing this information with verified conversion shops on the platform for the purpose of receiving proposals. Project information may be visible to registered Vendors.

6. Shop Listings

Vendors may create shop profiles and respond to project requests. Vendors represent that the information in their profiles is accurate and that they hold all necessary licenses and permits to perform the services they advertise. SwitchEV reserves the right to verify, approve, or reject shop listings at its sole discretion.

7. Payments and Subscriptions

Vendor subscriptions are billed through Stripe. By subscribing to a paid plan, you authorize SwitchEV to charge the payment method on file at the applicable rate. Subscriptions renew automatically unless cancelled before the renewal date. Refunds are handled on a case-by-case basis. SwitchEV does not process payments between Clients and Vendors for conversion work.

8. Communications

By providing your email address or phone number, you consent to receive transactional communications from SwitchEV, including account verification codes, project status updates, and system notifications. These communications are necessary for the operation of the Service. You may opt out of non-essential communications at any time.

9. Prohibited Conduct

You agree not to: (a) use the Service for any unlawful purpose; (b) submit false or misleading information; (c) impersonate another person or entity; (d) interfere with or disrupt the Service; (e) scrape, harvest, or collect data from the Service without authorization; or (f) use the Service to send unsolicited commercial messages.

10. Intellectual Property

The SwitchEV name, logo, and all related marks, content, and technology are the property of SwitchEV LLC. You retain ownership of content you submit to the platform, but grant SwitchEV a non-exclusive, royalty-free license to use, display, and distribute such content in connection with the Service.

11. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied. SwitchEV does not warrant the quality, accuracy, or reliability of any Vendor's work, and is not responsible for disputes between Clients and Vendors.

12. Limitation of Liability

To the maximum extent permitted by law, SwitchEV LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service or any transaction between Clients and Vendors facilitated through the Service.

13. Termination

SwitchEV may suspend or terminate your access to the Service at any time, with or without cause, with or without notice. Upon termination, your right to use the Service ceases immediately.

14. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of New Hampshire, without regard to its conflict of law principles. Any disputes arising from these Terms shall be resolved in the courts of the State of New Hampshire.

15. Changes to Terms

We may update these Terms from time to time. We will notify users of material changes by posting the updated Terms on this page with a revised "Last updated" date. Continued use of the Service after changes constitutes acceptance of the revised Terms.
